Melton Family Refiles Lawsuit Against General Motors


Advocate Capital, Inc. clients Cooper Firm In a formal press release and news conference earlier this month, Ken and Beth Melton announced via their counsel Lance Cooper that they have re-filed their lawsuit against GM alleging that the automaker fraudulently concealed critical evidence and allowed its corporate representatives to commit perjury.  Additionally, the Meltons have asked the court to sanction GM for its discovery abuses and the spoliation of evidence.


The case has received national attention with far-reaching implications for General Motors and NHTSA (National Highway Transportation Safety Association) which also knew about the defect in 2007.  In an interview with local WSB-TV 2 in Atlanta, Mr. Cooper explains the basis for the new lawsuit:

The Meltons would not have settled their case if they had known of the perjury and concealment of critical evidence.  It is now apparent that GM’s plan was to resolve the Meltons’ claims before disclosing the Cobalt ignition switch design changes.


Where will it all end?  Will General Motors ever take the high road and “do the right thing” for the Meltons and all other families impacted by its defective products and subsequent unscrupulous litigation practices?

Social Media Ethics for Voir Dire

The ABA Journal reported in its April 24, 2014 edition that ABA Standing Committee on Ethics and Professionalism has issued a formal opinion regarding lawyers who research potential jurors through social media on the internet.


Terry Carter confirms that in Formal Opinion 466, the Committee concluded that attorneys may view public information available on the internet during the jury selection or voir dire process; however, they may NOT communicate directly with the jurors.


Three specific examples were cited:


  1. Looking at information available to the public on social media accounts is the “mere act of observing” and is not improper ex parte conduct . . . much like driving down a juror’s street to view this home.
  2. Asking a juror for access to his/her social media IS improper . . . more like stopping at the juror’s house and asking for a look inside.
  3. Learning through a notification feature that a lawyer has reviewed public information on a juror . . . similar example when a neighbor saw the lawyer’s car pass by and told the juror.  Essentially, the social media platform is communicating with the juror, not the lawyer.


Several other murky issues were reviewed including a lawyer’s obligation as an officer of the court to notify the presiding judge of possible misconduct by a juror discovered on social media.   The entire opinion is available here.


Social media continues changing our lives and it certainly is no surprise that it will impact our judicial process as well.
