Time to Pay it Forward

 

Tina Burns and Tiffany Orth Pay It Forward Award A few weeks ago, I was honored and humbled to receive our “Pay it Forward” award from one of our Marketing Coordinators, Tiffany Orth. Tiffany surprised me when she called my name during our weekly company meeting.

 

After having the award sit on my desk for a few weeks, it was my turn to pay it forward to the next recipient. This was a difficult task because we have such a great team at Advocate Capital, Inc. with so many deserving employees.

Lance Cooper Named Daily Report’s 2014 Newsmaker of the Year

The Daily Report recently recognized Lance as Newsmaker of the year “for illuminating the power of discovery in 2014.”   The article “Lance Cooper and the Power of Discovery: One Case, 30M Recalls” highlights the intense discovery work by Lance and his team in the Melton vs. GM case.  The arduous process of reviewing thousands of documents and numerous depositions would ultimately reveal that not only was the Chevrolet Cobalt’s ignition switch defective but that GM officials were aware of the faulty part.  The ensuing NHTSA investigation eventually led to 30MM recalls by GM.

 

In the article, Lance very humbly states, “Cases are won and lost in discovery.  If you don’t have the evidence you need, it doesn’t matter how good a trial lawyer you are.”  Mr. Cooper also shares a rare glimpse into his personal life discussing his family, core values and how he plans to keep his practice small so he can be involved in every lawsuit even after the flood of cases this year in the wake of Melton vs. GM.

Ending Our 2014 Tradeshows with LAJ

 

Paralegal of the Year Winner Regina Valenti with Tina BurnsPaul Myers and I completed Advocate Capital’s 2014 tradeshow season with Louisiana Association for Justice Last Chance CLE Conference in New Orleans. Tom Wright and the entire LAJ staff hosted a great show with careful execution and planning. This was our first year to exhibit with LAJ in the big easy and we finished our season strong. It was great seeing existing clients, meeting new friends and seeing our 2014 Paralegal of the Year winner, Regina Valenti of Herman, Herman and Katz.

 

The 2015 tradeshows appear to be promising and will certainly keep us busy.

A Challenge to Indiana Damages Cap

 

Copyright: <a href='http://www.123rf.com/profile_rudi1976'> / 123RF Stock Photo</a>A recent article by the Associated Press reports from Indianapolis that attorneys for a 13-year-old Ohio girl “hurt when a stage collapsed at the Indiana State Fair argued Monday that the state’s cap on liability damages is unconstitutional and should be thrown out by the Indiana Court of Appeals.” Jordyn Polet of Cincinnati “rejected Indiana’s offer of $1,690 to challenge the $5 million cap on total damages paid to victims of the 2011 collapse, which occurred when high winds blew down rigging before a concert by the country duo Sugarland. Seven people were killed and more than 100 were injured.” Jordyn’s attorney, Robert Peck, “argued the cap on total damages from a single incident means people are unconstitutionally denied equal treatment” and he said “that if she had suffered the same injury but had been the only casualty, she could have sought up to the $700,000 in individual damages.”

 

Originally, the state paid $5MM to about 62 victims and the Indiana General Assembly approved another $6MM for another 59 victims in 2012.  This settlement was found to be constitutional by the original judge, Marion County Judge Theodore Sosin.  Ms. Polet appealed this decision and oral arguments were recently heard in the Indiana Court of Appeals.

(NYSE:WFC) and New York Community Bancorp (NYSE: NYCB) also participating as lenders.

Industry News: Congratulations Kathleen Zellner!

 

Kathleen Zellner, Advocate Capital, Inc. friendOur friend Kathleen Zellner has been named Chicago Lawyer’s 2014 Person of the Year by Chicago Lawyer Magazine. The announcement was made in the December 2014 issue where she is appropriately titled “Kathleen Zellner, the rescuer” because of her tireless work helping those who have been wrongly accused and imprisoned. This well-earned distinction comes as she has won more overturned convictions than any private attorney in the country.

 

I have blogged about Ms. Zellner before and her $9M verdict in a civil lawsuit on behalf of Clyde Ray Spencer…Thanks to Ms. Zellner’s work Mr. Spencer was released from prison after 20 years of being wrongly accused.
