Defend Trade Secrets Act of 2015 Pending in Congress

 

Copyright : Songquan DengIn the rapidly moving world of intellectual property, ideas and trade secrets are becoming more and more valuable. As expected, this value has given rise to litigation surrounding the genesis of some ideas and business models.

 

An article in The Verge by Russell Brandom describes a new federal bill in Congress that would arm plaintiffs in these disputes with a federal cause of action and harsh consequences for any party losing such litigation. The bill is called the Defend Trade Secrets Act of 2015. Supporters of the bill say “it’s a necessary protection for companies facing unprecedented security threats”, while critics argue “it will give trade secret trolls an even heavier club to use against their targets.”

 

The article gives a few examples of current litigation where the bill would be helpful to plaintiffs. According to the article, the bill would make trade secret cases “easier to mount and even scarier for defendants.” The bill would force certain trade secret cases to federal court, “where the scale of the ruling can be far greater.” The law would also allow the courts to seize any contested property while it is being tried, “the same way they might seize allegedly counterfeit goods.”

Ron Netemeyer and Jill Harper Secure $3 Million Settlement for Client

 

Advocate Capital Inc. client Harper EvansCongratulations to Harper Evans Wade Netemeyer, and their client on receiving a $3 million settlement!

 

This client, represented by Ron Netemeyer and Jill Harper, was seriously injured in a motor vehicle accident in 2013. The plaintiff was a passenger in an automobile driven by her daughter travelling approximately 70 mph when the defendant driver failed to merge properly, striking the daughter’s car. The plaintiff was pinned under the car’s dashboard requiring extraction by the EMS. The plaintiff was lifeflighted to the hospital where her severe injuries were graded 10 out of 10. She sustained several burst fractures, including fractures of her sternum, tibias, fibulas, femur, elbow, wrist, neck, feet, ulna, hip and ribs. Her injuries required multiple surgeries, skin and bone grafts, and ultimately the amputation of her right leg below the knee. The plaintiff would spend close to a year in the hospital and skilled nursing center recovering from the injuries sustained in the accident.

 

After hiring experts to determine the client’s future medical expenses and lost income, attorneys Netemeyer and Harper were able to secure a $3,000,000 settlement for their client prior to trial.

Postmates: Office Lunches On-Demand

Recently, our Nashville based offices started using a great food delivery service called Postmates and our troubles have been solved.

 

Postmates is a growing delivery service company out of San Francisco. Their mission is “to become the on-demand delivery infrastructure for every major city in the world” and they are well on their way serving over 40 major metropolitan markets (see list) in the US.

 

Here’s how it works. After setting up an account, you select a restaurant in your area, which in Nashville is a pretty impressive list of local and chain restaurants. Each restaurant has complete menu items and a custom order option. Once your order is complete, the app searches for a Postmates driver in your area. What makes this service so special is you receive a photo of your driver and can track their route in real time. The driver will text you along the way with progress and your food will arrive under an hour.

 

We have had a lot of success using Postmates and they are always running specials like free donuts or discounted delivery. Visit the Postmates website to see if they are available in your city and download the app on iTunes or Google Play.

New NHTSA Tool Helps Consumers Track Vehicle Recalls

 

Photo Credit: Angela OllisonWe have blogged many times in this space about how vehicle recalls by the National Highway Traffic Safety Administration are important to ensure the ongoing safety of consumers.

 

Finding out if your vehicle is subject to a safety recall is now easier than ever.  According to a recent report by Edmunds, the NHTSA has produced a new video that “helps consumers understand the importance of their car or truck’s Vehicle Identification Number and whether that vehicle is subject to a safety recall.”  Consumers can enter their VIN number on the NHTSA’s VIN Lookup Tool and check to see if their vehicle has been recalled.
