Advocate Capital, Inc. friend and colleague, Lance A. Cooper, received a $1.1 million verdict for injuries sustained by a plaintiff when her car with faulty gear shift assembly ran over her resulting in a fractured pelvis with extensive therapy & rehab. The jury deliberated for approximately 3 hours and came back with the million+ verdict.
Plaintiff Roper was driving her 1994 Dodge Intrepid in November of 2007 while dropping off food for her grandchildren. Her 3 year old granddaughter reached into the center console of the car to pick up a drink and inadvertently put her hand on the gear shifter causing it to shift out of park. The driver’s side door knocked Ms. Roper over and the car ran over her.
The Intrepid had a defective gear shift assembly which caused it to move out of park when the keys were out of the ignition. Chrysler recalled the car in 2004 and Ms. Roper took hers to the dealer to have the recall work performed on three (3) separate occasions between 2004 and 2007. The recall work was never performed properly.
