Coming from me, this may sound like a rhetorical question (i.e. OF COURSE it’s time to rein in tort reform), but a recent article in Houstonia Magazine does an excellent job of reviewing the history of Texas tort reform and its impact on a family trying to get justice.
It tells the story of the DiLeo family and their struggles to get compensation for injuries suffered by their son, Jonathan. Jonathan suffered from a brain tumor and due to many errors by the medical staff at an unnamed hospital in Texas, Jonathan eventually died. The family tried, unsuccessfully due to damage limitations in Texas, to get justice for their son.
This is a heart-wrenching story of the horrible consequences of this type of legislation.
